Tuesday, November 25, 2025 — Jenifer McGovern, Nett’s attorney, filed a motion for continuance in the ongoing proceedings concerning the potential removal of Purcellville Vice Mayor Ben Nett from office. This motion aims to delay the court hearing that will determine whether Nett should be removed from his position on the Purcellville Town Council.

The case involving Vice Mayor Nett has drawn considerable public attention due to allegations of misconduct and the political dynamics involved. He faces six felony charges, including two related to bid rigging and conspiracy and four involving violations of the Virginia Criminal Information Network. The ongoing attempts to remove Nett from office include a recall petition filed by Special Prosecutor Eric Olsen on behalf of the Concerned Citizens of Purcellville on November 20.

This recall petition follows a grievance decision and various legal challenges resulting from investigations into allegations of database misuse, questionable involvement in consulting contracts related to police department restructuring, and his role in appointing Interim Town Manager Anthony Sabio.

Brian Morgan, leading the recall efforts, stressed the importance of addressing the broader issues, stating, “We’re not done yet. We need resolution regarding the Mayor and remaining two council members. The charges against Ben Nett demonstrate that our recall efforts are supported by solid evidence of improper conduct by the majority of the Town Council. We knew this process would take time and must be conducted correctly. It’s been a long eight months, and seeing progress now is gratifying. I want to extend sincere appreciation to the Purcellville community for their support.”

The motion for continuance is intended to provide all parties with additional time to prepare for the upcoming legal proceedings. The previously scheduled December 1st hearing at 9:00 a.m. was not the main hearing, but rather a return date used solely for scheduling purposes. It has now been set as a Status Hearing on December 1 at 9:30 a.m. at the Loudoun County Courthouse. During that hearing, the court will address scheduling matters, and a new date for the continuance and further proceedings will be determined.
