Today, February 12, Judge Fleming heard arguments related to the motion for joinder in the case of Commonwealth of Virginia v. Nett/Fraser at the Loudoun County courthouse.

The motion, filed by Special Prosecutor Eric Olsen, seeks to combine the cases against Vice Mayor Carl “Ben” Nett and Purcellville Town Manager Kwasi Fraser .

During the hearing, Nett’s attorney, Ryan Campbell, and Fraser’s attorney, John Boneta, requested additional time to review a memorandum filed Tuesday by Olsen in support of the joinder motion. Olsen acknowledged that the memorandum was filed late due to obligations in another case. While consenting to the defense’s request for additional time, Olsen asked the court to set a speedy trial and requested a placeholder trial date. That request was denied by Judge Fleming.

Judge Fleming directed Campbell to file Nett’s opposition to the motion for joinder by Tuesday. Boneta had already filed Fraser’s opposition on February 11.

The court scheduled the next hearing for February 19 at 1 p.m., when Judge Fleming is expected to hear further arguments regarding the joinder motion.

The case stems from a July 23 grand jury indictment charging Nett and Fraser with computer trespassing and conspiracy related to alleged bid-rigging and fraudulent activities in Purcellville. The charges are classified as Class 6 felonies, which carry potential penalties of one to five years in prison or a fine of up to $2,500.

A trial date has not yet been set however Judge Fleming indicated the trial date may be scheduled at the conclusion of next week’s hearing.
